Procedures for Master Pleadings and Short Form Zantac Complaints Requirement in Personal Injury Cases.

The scope of the order is set forth below.

I. SCOPE OF ORDER

This Order applies to all Zantac bodily injury claims already filed within Multidistrict Litigation Case No. 2924.  In addition, the Order covers all personal injury actions transferred to or directly filed in MDL No. 2924 after the date of this Order or otherwise expressly identified herein.

The broad scope of the Order covers all Zantac claims in or entering the multi-district lawsuit.

The ranitidine complaint requirements appear below.

II. Master Zantac Pleading Requirements

In light of the number of complaints filed to date and likely to be filed in or transferred to MDL No. 2924, and the inefficiencies of drafting unique complaints and individual answers to those Zantac complaints, the Parties have agreed to the following procedures for the use of master Zantac pleadings in personal injury cases. Nothing in this Order is intended to (or does) alter the applicable provisions of the Federal Rules of Civil Procedure or the Local Rules of this Court, except as otherwise provided herein or in any subsequent Order.

A. Master Zantac Complaint Requirements

1. Timing of Antacid claims

By June 22, 2020, Plaintiffs shall file a Master Personal Injury Zantac Complaint on behalf of all Plaintiffs asserting Ranitidine personal injury claims in MDL No. 2924.

2. Effect of Master Personal Injury Zantac Complaint Requisites.

Any single Zantac pleading requirement could effect the outcome of the litigation.

All claims pleaded in the Master Personal Injury Zantac Complaint will supersede and replace all claims pleaded in any Ranitidine complaint previously filed
in or transferred to MDL No. 2924, to the extent applicable under the procedural and substantive law that applies to previously filed actions, including this Order. Nothing in this Order shall preclude Plaintiffs from seeking leave to amend the Master Personal Injury Zantac Complaint requirements as provided in the Federal Rules of Civil Procedure.
